for all bookings and photo sessions via urlaubsfotoshooting.com

I. General
1.1 These Terms and Conditions apply to all bookings, photo sessions, and related services arranged or provided through urlaubsfotoshooting.com (operated by Chocosite LLC, Florida, USA – hereinafter referred to as “the Provider”).
1.2 By booking (in writing, by e-mail, or through the website), the client accepts these Terms and Conditions.
1.3 Any differing terms from the client apply only if expressly confirmed in writing by the Provider.
1.4 These Terms also apply to all future bookings without requiring renewed agreement.
II. Services and Mediation
2.1 The Provider arranges professional photographers at various holiday destinations worldwide.
The actual photo session is carried out by the local photographer assigned to the client’s location.
2.2 The Provider ensures standardized communication, organization, and quality management.
This includes scheduling, client communication, image selection, and post-production.
2.3 No entitlement to a specific photographer:
The client has no right to request a specific photographer.
The Provider will assign the most suitable and available photographer for the desired time and location.
A change of photographer due to logistical or organizational reasons does not justify any reduction, withdrawal, or claim for damages, as long as the agreed service is delivered in equivalent quality.
2.4 Final images will be delivered digitally through a secure online gallery.
III. Usage Rights
3.1 Upon full payment, the client receives the exclusive, worldwide, and unlimited usage rights to all delivered images.
3.2 The Provider and the assigned photographers retain no rights of their own.
3.3 Any use of images by the Provider (e.g., for advertising or portfolio purposes) requires the client’s prior written consent.
IV. Fees and Payment Terms
4.1 The agreed fee at the time of booking applies.
4.2 Invoices are issued by Chocosite LLC, Florida, USA. No VAT is shown.
4.3 Payments are to be made by bank transfer to the account specified by the Provider:
Currencies: EUR or USD
Account: European IBAN account in Belgium (details stated on the invoice)
4.4 Invoices are payable immediately and without deduction.
4.5 Late payments may incur reminder fees and interest charges.
V. Cancellations and Rebooking by the Client
5.1 Failure to appear at the agreed session does not release the client from payment.
5.2 Holiday Shoots: Cancellations up to 14 days before the scheduled session are accepted; the booking fee is non-refundable.
5.3 Wedding Shoots: Cancellations up to 4 weeks before the scheduled date are accepted; the booking fee is non-refundable.
5.4 Late cancellations:
a) Holiday Shoots: Cancellations within 14 days before the session require full payment.
b) Wedding Shoots: Cancellations within 4 weeks before the session require full payment.
The Provider will attempt to offer an alternative date within the same season (until October 30), but payment remains due on the original date.
5.5 Illness of the client: The client may reschedule the appointment, but no refunds are possible. The Provider recommends purchasing travel or cancellation insurance.
5.6 Gift vouchers are non-refundable and excluded from withdrawal.
VI. Right of Withdrawal
6.1 There is no statutory right of withdrawal for individually arranged services (such as photo sessions).
6.2 Likewise, there is no withdrawal right for already delivered digital image files.
VII. Liability
7.1 The Provider is liable only for intent and gross negligence.
7.2 Liability for travel, weather, location conditions, or items brought by the client is excluded.
7.3 The operational execution of the shoot is the responsibility of the assigned photographer.
The Provider ensures the selection of qualified photographers according to unified standards but cannot be held liable for their individual behavior or artistic style.
7.4 Mandatory legal liability (e.g., for personal injury) remains unaffected.
VIII. Final Provisions
8.1 Any amendments or additions must be made in writing.
8.2 If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in full force.
8.3 Jurisdiction, where legally permissible, is the registered office of Chocosite LLC, Florida, USA.
