General Terms & Conditions for urlaubsfotoshooting.com — booking, services, fees, cancellation, usage rights and liability.

I. General

1.1 These General Terms & Conditions (T&Cs) apply to all photo shoots, bookings and services arranged or provided through the platform urlaubsfotoshooting.com (operated by Chocosite LLC, Florida, USA, hereinafter "Provider").

1.2 By making a booking (in writing, by email or via the website), the client accepts these T&Cs.

1.3 Deviating terms and conditions of the client only apply if confirmed in writing by the Provider.

1.4 These T&Cs also apply to future orders without the need for renewed agreement.

II. Services & Brokerage

2.1 The Provider arranges professional photographers worldwide. The shoot is carried out by the photographer deployed on location.

2.2 The Provider ensures consistent handling, communication and quality standards.

2.3 Image material is made available in digital form via an online gallery.

2.4 Professional image editing is included: removing distracting elements, optimising exposure, adjusting skin tones, correcting the horizon and refining the crop. Optional extras such as beauty retouching, make-up corrections or compositing are available at an additional charge.

III. Usage Rights

3.1 Upon full payment, the client receives the sole, unlimited usage rights — unrestricted in time and territory — to the delivered images.

3.2 The Provider and the photographers deployed retain no usage rights of their own.

3.3 Any use of the images by the Provider (e.g. for social media or advertising purposes) requires the prior express written consent of the client.

IV. Fees & Payment Terms

4.1 The fee agreed at the time of booking applies.

4.2 Invoices are issued in the name and on account of Chocosite LLC, Florida, USA. No VAT is shown.

4.3 Payment is made by bank transfer to an account specified by the Provider:

• Currencies: Euro (EUR) or US Dollar (USD)
• Payment account: European IBAN account in Belgium (bank details provided on the invoice)

4.4 Invoices are due immediately and without deduction.

4.5 In the event of late payment, reminder fees and default interest may be charged.

V. Cancellation & Rebooking by the Client

5.1 Failure to appear at the agreed shoot date does not release the client from the obligation to pay.

5.2 Vacation Shoot: Cancellations are possible up to 14 days before the shoot date. Booking deposits already paid will not be refunded.

5.3 Wedding Shoot: Cancellations are possible up to 4 weeks before the booked date. Booking deposits already paid will not be refunded.

5.4 Late Cancellations:

• Vacation Shoot: Cancellations less than 14 days before the shoot date will result in the full fee becoming due.
• Wedding Shoot: Cancellations less than 4 weeks before the booked date will result in the full fee becoming due.

In both cases, the Provider will endeavour to offer a replacement date within the current season (until 30 October); the fee remains due no later than the originally booked date.

5.5 Client Illness:

• The client has the option of arranging one replacement date.
• No refund of the fee will be made.
• The fee remains due no later than the originally booked date.
• The Provider recommends taking out travel or cancellation insurance.

5.6 Vouchers are excluded from the right of withdrawal and are non-refundable.

VI. Right of Withdrawal

6.1 No statutory right of withdrawal exists for individually agreed services (photo shoots).

6.2 No right of withdrawal exists for images already delivered in digital form.

VII. Liability

7.1 The Provider is only liable for intent and gross negligence.

7.2 Liability for travel to and from the location, weather conditions, local circumstances or items brought by the client is excluded.

7.3 The conduct of the shoot is the responsibility of the photographer deployed. The Provider guarantees the selection of vetted photographers according to uniform standards but accepts no liability for their individual conduct.

7.4 Liability under mandatory statutory provisions (e.g. personal injury) remains unaffected.

VIII. Final Provisions

8.1 Amendments and additions must be made in writing.

8.2 Should individual provisions of these T&Cs be invalid, the validity of the remaining provisions shall remain unaffected.

8.3 Jurisdiction, where permissible, is the registered office of Chocosite LLC, Florida, USA.
