§ 1 Scope
These Terms & Conditions govern all bookings and photo shoots arranged through the platform urlaubsfotoshooting.com, operated by Chocosite LLC, 3833 Powerline Rd, Suite 201, Fort Lauderdale, FL 33309, USA.
§ 2 Services
urlaubsfotoshooting.com arranges professional photographers at holiday destinations worldwide. Upon full payment, the client receives the sole, unlimited usage rights to the delivered images for private and commercial purposes.
§ 3 Booking and Payment
Bookings are made via the online form or by email. A deposit is due upon booking confirmation. The remaining balance is to be paid directly to the photographer on location, in cash or by bank transfer, before the shoot.
§ 4 Change of Photographer
Clients have no entitlement to a specific photographer. A necessary change does not give rise to any claims for reduction or damages, provided an equivalent replacement is made available.
§ 5 Cancellation – Vacation Photo Shoot
- Cancellation up to 14 days before the appointment: possible; deposits already paid will not be refunded.
- Cancellation less than 14 days before the appointment: the full fee becomes due.
- In the event of bad weather: a free alternative date within the stay will be arranged.
§ 6 Cancellation – Wedding Shoot
- Cancellation up to 4 weeks before the appointment: possible; payments already made will not be refunded.
- Cancellation less than 4 weeks before the appointment: the full fee becomes due.
§ 7 Liability
urlaubsfotoshooting.com is only liable in cases of intent and gross negligence. Liability for weather conditions, technical failures or artistic decisions of the photographer is excluded. Total liability is limited to the booking amount.
§ 8 Right of Withdrawal
The right of withdrawal is excluded for individually agreed services and for digital content (photo galleries) already delivered.
§ 9 Image Rights
All delivered images become the sole property of the client upon full payment. The photographer and urlaubsfotoshooting.com may only use images for their own marketing purposes with the express written consent of the client.
§ 10 Final Provisions
Should individual provisions of these Terms & Conditions be invalid, the remaining provisions shall remain unaffected. The laws of the Federal Republic of Germany apply, insofar as mandatory consumer protection provisions of the client's country of residence do not conflict.
